- ADDMG attorney Neal J. Blaher filed an
arbitration claim against Charles Schwab & Company, Inc., on
behalf of one of several customers who had sought
broad-based financial advice for retirement funds but whom
Schwab directed to Winter Park option trading firm,
Alexander Read Investment Management, Inc., January 2009.
Read was a member of the Schwab Advisory Network, a
specially-selected group of small, independent financial
advisory firms that purport to offer Schwab customers a
higher level of investment advice. However, rather than
offer broad financial planning, Read directed customers,
often using funds earmarked for retirement, into highly
speculative option trading strategies, both through
individual transactions and by pooling customers into “hedge
funds” such as the Fennec Hedge Partners LP. Just days
before Blaher’s filing, but a full 10 years after bringing
Read in, Schwab terminated Read’s participation in the
Network “due in part to issues with alternative investments
managed by Read,” including Read’s Fennec option trading
fund.

- ADDMG'S client enjoys patent infringement victory. On February 12, 2007, after a two week trial, a Jury has ruled that a major consumer electronic manufacturer, Directed Electronics, Inc., had willfully infringed Omega’s patents.
As the Court pointed out, "The Jury found for Omega and against DEI on every question." [Case No. 6:05-cv-1113-Orl-22DAB] The Court subsequently entered an injunction and then took the extraordinary step of trebling the damages and ordering Direct to pay all of Omega’s attorneys’ fees. The Court pointed out that Directed’s conduct was outrageous and it tried to bankrupt Omega by running up litigation expenses and fabricating defenses. In all, Omega prevailed on its claims Directed Electronics infringed over thirty five claims of Omega’s patents, all of which Directed claimed were invalid or unenforceable. In spite of this action pending for over two years, ADDMG was able to manage costs and fees in order to prevent the much larger infringer from prevailing solely on the basis of economic superiority.
Because of the overwhelming victory, Omega was able to negotiate a confidential settlement agreement after the verdict that was extremely favorable to the long term goals of the client. "I am overwhelmed and extremely grateful to ADDMG. Each lawyer exhibited professionalism while at the same time being aggressive, leading to this incredible success," said Omega’s Ken Flick. Brian R. Gilchrist, as lead Trial Counsel, and Ryan T. Santurri tried the case. Christopher F. Regan, Esq., who drafted the underlying patents, provided technical support.
- ADDMG'S client prevails on appeal. On February 22, 2007, the United States Court of Appeals for the Eleventh Circuit affirmed an Order dismissing a copyright action which Allen, Dyer, Doppelt, Milbrath & Gilchrist obtained from the District Court. The Order dismissed a copyright action brought by Home Design Services, Inc. against Schwab Development due to Plaintiff’s activities at trial. [Case No. 6:03-cv-596-Orl-28DAB]. Home Design Services appealed the Lower Court's decision, but to no avail. In fact, the Eleventh Circuit found plaintiff's appeal so unavailing that it awarded ADDMG's client its attorneys fees for having to defend the case on appeal. [Appeal No. 06-10003] Brian R. Gilchrist was both lead Trial Counsel and lead Appellate Counsel.
- ADDMG Attorneys commended, July 2007. Mr. W Scott Jones recently wrote an unsolicited letter to The Florida Bar in regard to representation by attorneys Herbert L. Allen, Brian R Gilchrist, Jeffrey S Boyles and Steven H Luther. In part Mr. Jones wrote:
“For the record my first initial contact with the firm was through Mr. Herb Allen, who expertly suggested initial strategy for our case. Daily ongoing case management has been by Mr. Brian R. Gilchrist and Mr. Jeffrey S. Boyles. My almost daily interaction with Mr. Boyles and Mr. Gilchrist, as well as a multitude of courteous, knowledgeable paralegals and support staff has made this nightmare bearable as our case steadily moves toward a just resolution. And finally, our meticulous patent application was crafted by yet another of their firms attorneys, Mr. Steven Luther which in it self required substantial immersion in to our product’s science, just to the patent application correct.
… Although many would maintain that their professionalism is “what a legal client is paying for” or “ that is what attorneys are supposed to do for their clients,” I can assure you, this firm and these attorneys are the exception. Regardless of our case outcome, my company could not have asked for more diligent and comprehensive representation and were damn fortunate to have them on our side.”

Special recognition was given to Jeffrey Boyles, Ava Doppelt, Enrique Estevez and Stephen Milbrath, for their volunteer work as well.
- ADDMG Attorney Jack Abid published “Software
Patents on Both Sides of the Atlantic,” in the John
Marshall Journal of Computer and Information Law cited
